1. Acceptance of Terms
By accessing or using the Aiscenix platform ("Platform"), operated by Kingbird AI ("Company," "we," "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree with any part of these Terms, you must not use the Platform. We reserve the right to modify these Terms at any time, and your continued use constitutes acceptance of any changes.
2. User Accounts
You must be at least 13 years of age to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate, current, and complete information during registration. We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.
3. Content and Creators
Creators retain ownership of the original creative elements in the content they upload. By publishing content on Aiscenix, creators grant the Platform a worldwide, non-exclusive, royalty-free license to host, display, distribute, and promote their content within the Platform and related marketing channels. Creators are responsible for ensuring they have the rights to publish all material included in their uploads.
4. Token Economy & Payments
Aiscenix operates a token-based economy for accessing premium content. Tokens are purchased with real currency and are non-refundable except where required by applicable law. Token prices are set by the Platform and may change at any time. Creator payouts are calculated based on token redemptions, and specific payout rates and schedules are described in the Creator Agreement. The Platform retains a service fee on each transaction as disclosed in the Creator Dashboard.
5. Intellectual Property
The Aiscenix name, logo, branding, and Platform software are the intellectual property of Kingbird AI and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Platform without express written permission. User-generated content remains the property of its respective creators, subject to the license granted in Section 3.
6. AI-Generated Content Policy
Aiscenix is designed for AI-generated and AI-assisted filmmaking. Creators must disclose the use of AI tools in their content production. Content generated using AI must not infringe on the intellectual property rights of third parties, including but not limited to the unauthorized use of likenesses, voices, or copyrighted materials as training inputs. The Platform reserves the right to remove content that violates this policy.
7. Prohibited Conduct
You agree not to: (a) upload content that is illegal, defamatory, obscene, or promotes violence; (b) use the Platform to harass, bully, or threaten other users; (c) attempt to gain unauthorized access to the Platform's systems or other user accounts; (d) use automated tools, bots, or scrapers to access the Platform; (e) circumvent any content protection mechanisms or token payment systems; (f) misrepresent your identity or affiliation with any person or entity.
8. DMCA & Copyright
We respect the intellectual property rights of others and comply with the Digital Millennium Copyright Act (DMCA). If you believe that content on the Platform infringes your copyright, please submit a DMCA takedown notice to legal@aiscenix.com with the following information: (i) a description of the copyrighted work, (ii) the URL of the infringing content, (iii) your contact information, (iv) a statement of good faith belief, and (v) a statement under penalty of perjury that the information is accurate.
9. Limitation of Liability
To the maximum extent permitted by law, Kingbird AI and its affiliates, officers, directors, and employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform. Our total liability for any claim arising from or related to these Terms shall not exceed the amount you paid to the Platform in the twelve (12) months preceding the claim. The Platform is provided "as is" without warranties of any kind, either express or implied.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes arising from or relating to these Terms or your use of the Platform shall be resolved through binding arbitration administered in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in any court of competent jurisdiction.
11. Changes to Terms
We may update these Terms from time to time. When we make material changes, we will notify registered users via email or an in-platform notification at least 14 days before the changes take effect. Your continued use of the Platform after the effective date constitutes acceptance of the revised Terms. If you do not agree with the updated Terms, you must discontinue use of the Platform.
